Background

On May 25, 2018, the General Data Protection Regulation came into force, which protects the fundamental rights and freedoms of natural persons, in particular their right to protection of personal data. Casper Advokater AB's employees and consultants are committed to protecting the rights of data subjects under the Data Protection Regulation.

 

Controller of personal data

Casper Advokater AB, org. 556616-1260, is the data controller for the personal data processed by the law firm and/or its consultants. Casper Advokater AB also undertakes assignments as a bankruptcy administrator. A bankruptcy administrator processes personal data partly within the framework of the bankruptcy estate's operations and partly in the law firm's normal operations. The bankruptcy estate is the controller of the personal data we receive in connection with the management of staff employed by the bankruptcy estate, continued operations in the bankruptcy estate, divestment of the estate, accounts prepared in the bankruptcy and recovery in bankruptcy. Casper Advokater AB is the data controller for the personal data we otherwise receive in connection with the preparation and execution of the assignment as bankruptcy administrator. The following applies to both the bankruptcy estate's and the law firm's processing of personal data unless otherwise stated.

Personal data we process

Personal data is any information that, alone or in combination with other data, is intended to identify or identifies a natural person. This may include, for example, name, address, telephone number and e-mail address.

 

Our processing of peronal data and basis for processing

We process personal data in a lawful, accurate and transparent manner in relation to the data subject. Processing of personal data takes place when it is necessary. We process personal data for specified, explicit and legitimate purposes. We work to minimize the amount of personal data processed and to ensure that the data we process is always accurate and up-to-date. Personal data is not stored for a longer period than necessary, see more below. Personal data is processed in a secure manner. We only process personal data when there is a legitimate basis under Article 6 of the Data Protection Regulation. As a bankruptcy administrator, partly within the framework of the law firm's normal activities and partly within the activities of the bankruptcy estate, and liquidator, we process personal data as part of fulfilling a legal obligation incumbent on us by law. When we handle wage guarantee matters, we also exercise official authority. As an agent, company reorganizer and employer, we process personal data in order to fulfill an agreement between us and the client.

 

Deletion of personal data

We delete personal data when our obligation under the Code of Conduct for Swedish Lawyers no longer requires otherwise. Personal data is stored for 10 years from the conclusion of the case or such longer period as the nature of the case requires.

 

Transfer of personal data

We only disclose personal data to third parties when there is this is agreed between you and the law firm or the bankruptcy estate, when it is necessary in order to safeguard your rights, when we are required to fulfill a statutory obligation, to comply with the decision of an authority or court or when we engage a consultant to perform an assignment on our behalf. In some cases, the bankruptcy estate works with personal data assistants such as consultants for the valuation and disposal of property. Similarly, it happens that the law firm works in a similar way with personal data assistants, such as economists who review accounting material and IT support on behalf of the law firm. These consultants then have access, to varying degrees, to our work material. When we work together with consultants, so-called data processors, there are data processing agreements that ensure that the data processor complies with the Data Protection Regulation. The data processors follow our instructions in their work. Personal data may also be disclosed to courts, authorities, county administrative boards, etc.

 

Transfer of personal data to third countries

There is currently no intention to transfer personal data to third countries.

Your rights

​

Right of access

You have the right to request an extract from the register free of charge, stating whether we process personal data about you and, if so, what personal data and in what way. A charge may be made if the register extract involves a significant amount of work for the law firm (or the bankruptcy estate). Anyone requesting personal data regarding themselves will have to identify themselves at the law firm's office to ensure that the right person receives the right information.

Rectification and deletion of personal data

Contact us if you discover that personal data about you is incorrect. At your request, we will correct your personal data without delay. Should we discover inaccuracies, we will also correct personal data on our own initiative. You can also request that we delete personal data about you, the “right to be forgotten”.

 

Objections and restriction

You can object to how we process your personal data . You can also request that we restrict the processing of your personal data.

Data portability

You have the right to request that personal data concerning you be transferred to a third party. This will happen if technically possible.

 

Personal data breach

Casper Advokater AB has taken technical and organizational measures to not risk the security of personal data. Should you become aware that a security incident has occurred where one or more personal data has been accidentally disclosed, you are asked to contact the law firm as soon as possible.

 

If you are dissatisfied

If you are dissatisfied with the way we process your personal data, please contact us as soon as possible. If you think we are processing your personal data incorrectly, you can also lodge a complaint with the Data Protection Authority (www.datainspektionen.se). You can also contact the supervisory authority in the country where you live or work.
